Mixtapes are a different discussion. If a dj/livbe set adds enough artistic input one could argue that the result is a new, yet derivative work. That doesn't compare at all to the main subject of this thread.
Let's sum it up.
1/ mixtaping/mashing up/remixing/editing is ok
2/ mixtaping/mashing up/remixing/editing without saying it's a mashup/mash-up/remix/edit is OK if you can live with it.
