Good day together!

I hereby officially request to Gargaj to remove all of my content from pouet.net already last week without a result. I would like to delete everything here. This includes profile, forum posts, onlineliners, logos, mentions on productions, as well as productions of the group TheRavebusters appears. I no longer want to be mentioned or associated in your demo culture. That is my right too. Yes there is the "right to be forgotten" just google it.

If you comply with this wish, we will all benefit from it, as you will never read/hear/see anything from me again and hopefully I will no longer read/hear/see from you guys.

D4XX your name is a pseudonym. It is not directly connectable to a "natural person" without extra information, so no personal data (german: "personenbezogene Daten") is stored.
You can simply delete your account. I'm no lawyer, but I'd say having your logos removed is within your rights (not because of the "right to be forgotten" though). Having "metadata" like the listing of productions removed from the pouet DB is not. Pouet does not host productions. If you want your creations removed you need to contact the hoster.

It's a shame though. I liked some of your logos a lot.

I will always remember that great demo you coded. That one with the starfield. The one from the 90s, with vector graphics. I forgot the name, but it’s my favourite one. God bless you, take care!

The 'right to be forgotten' is being invoked here but includes an exception when it conflicts with the freedom of expression, which has been interpreted in the context of internet forums et cetera to mean that erasure would disrupt existing expressive content on the site (e.g. forum threads, comments, et cetera) too much it does not apply. I think Pouet is hosted in The Netherlands, which has further exceptions for content with "journalistic, academic, artistic or literary forms of expresison". Whether Pouet comments and threads qualify as such is a question for lawyers, but my point is that "I invoke the right to be forgotten!" is not a magic incantation that will force a site admin to delete everything linked to your account from the site.

Of course, there is some content that would not fall under these exceptions in any case, for example the information on your profile, but you can already delete all of that via the Pouet interface, and even change your username to something generic if you want to dissociate the content from the word 'D4XX'.

Oh, to add, I did not mention the exception to the right to erasure for "archiving purposes in the public interest, scientific or historical research purposes or statistical purposes". Insofar as Pouet's is a demoscene archive, that exception might also apply here.

The legislation also contains the provision that the data controller has to take action "without undue delay". What that means exactly would again be something for a lawyer (or judge) to decide, but I'm pretty sure it would be more than 3 days - most sites mention a period of several weeks in their data policies.
