Yap. Because they are not making money with these sources at that testing time. They are "losing" (investing) money at the moment, because they dont sell anything but only have development costs. Heck, these tests even can result into losing money forever because they show they fail to produce a working shader environment and have to drop the project all together because all tests fail.
At this moment "commercial profit" is a speculation, not a fact.

To test the routing of our customers equipment I send pings from it to commercial websites without asking them for permission first, sometimes I even increase the packet size.

Contrary to what some people think, I don't do music / audio / DJing for a job. think my days for that are long gone, although I did have a good crack it in back in the 00's (see previous vinyl releases and seriously reduced brain cell count for details).
I'm actually a team leader / developer in .NET and SQL for a local software company dealing with warehousing, eCommerce and order management systems. Not the coolest of jobs but luckily it's stable and I enjoy it.

This isn´t true in general. Otherwise any company could happily use their $10k-per-unit CGI/CAD/wotever software without paying anything for it.
Unfortunately the CC license isn´t very specific regarding in-house use as it is mainly targetting distribution and reuse, which makes sense as it is focused on video/audio/imagery etc. and not well-tailored for software.
So far bsps use case still seems to be ok, but legally speaking still in the grey area.
