Now Smash: I request of you to retract the complaint at YouTube. If you don't, then I will send a mail to YouTube stating that the complaint was only regarding an irrelevant snippet of the videos and not the main content itself. That's not a threat, because I am sure that YouTube gives a damn about it, unless you send a Lawyer after them (that's not an assumption btw). I stated the reasons for this step in my blog post.
I hope you saw that I did provided credits, where the intro snippet itself was up for discussion. I don't mind to add to the end of the video a text that the intro snippet is based on a few seconds segment of a demo of whose creation you were part of. Code & Gfx: Smash/FLT, Gfx: Navis/ASD, Music: Keito/Alcatraz (Hey Keito, the music rocked btw).
Also, if you don't want me to use your stuff at all, let me know. I would be a bit surprised though, because I believe that recognition is the main driving factor why we do what we do.
How does this sound to you? Is it something you can agree on? Let me know. I sent you my direct email via LinkedIn. It's also listed on the COntact page at Cumbrowski.com, which you obviously found already. :)

1. when i first found out that you (not knowing you were a scener at this point) had stolen some of our demo, i contacted you via your "contact" page on your website. i got a response saying it was delivered. so, i assume you read it. at that point i assumed you were just a random youtube lamer, so i said along the lines of "explain yourself and remove the content".
you didnt respond.
i dont know why i bothered finding you and contacting you at all, actually. thats more effort than i should have taken. that's clearly more work than you put into finding who made the video you ripped off so you could contact them and ask nicely.
2. i got bored of waiting after 2 days (my time), and assumed you werent going to respond, so i filled in the short form on youtube to get it removed. thinking to myself at the time that i should have just done that in the first place - why did i even bother giving the guy a chance to explain?
3. i discovered you were a scener - thanks to someone on here pointing it out. that just irritated me even more, because a scener should a) know where to find the authors and so on to ask them if they could use the stuff, and b) should know a lot better than to rip it off in the first place.
4. you woke up and started complaining loudly on your blog, pouet and other sources about how incredibly unfair it is that someone would dare post a copyright violation notice about any of "your" work.
you managed some classic quotes like "Team Mates or Hates?" and bitching about sony, and demanding that i remove the copyright violation notice.
So, let me explain where you went wrong.
1. you ripped off someone elses work without credits, and claiming it was yours (i quote: "beta of my new intro"). you say "a few seconds - 15s and 45s" - 45 seconds is 25% of the demo.
2. you fucked up said work by adding some horrible text, destroying the encoding (oh wait, you called that "effects" i think) and breaking the aspect ratio.
3. you never attempted to ask permission or contact the authors at all - even claiming you didnt know who to credit. thats funny because you know where pouet is, you know where to find the demo, and presumably knew to read the info file linked on pouet for your convenience, which had the names and full emails of everyone involved. the irony being you used to make ascii/ansi for info files, so you should be familiar with the concept.
4. when caught out, doing the decent thing and apologising and removing the content didnt enter your head. instead you made things worse by getting defensive and kicking off about it - blaming ME for not contacting you about the issue and so on.
you managed to make things worse by posting irate blog posts dissing me, by thumbing the demo down on pouet (hey, it was good enough for you to rip off - show a little respect, no?) and so on. you started saying how un"scenelike" it all was - well, all this ripping and so on is as un-scenelike as you can get. in my mind a scener wouldnt act like that.
to summarise: from my point of view, you ripped us off, you didnt respond to contact asking to explain yourself - a step we needn't bother have taken, and im sure many others wouldnt have. you got incredibly upset when your videos were removed for a (completely accurate) copyright violation, and you got angry at us about it.
if you wanted to clear this up you could have done so in 10 minutes by a) holding your hands up and apologising, and b) removing the material. job done.

Roy: the reason I said I agree with smash is because I do so in principle. I haven't read much of what was said in the blog or here, but I must say that any other time people have used visuals from an ASD demo they always asked us beforehand.
But ok, it is not the crime of the century, you didn't make any money and that's all fair enough. Needless to say I don't agree with some sort of mistreatment you got in this bbs, but then again it is pouet and we've all have had some over the years.
