a lot more have obviously done that style, but personally i note em most for using that kinda sound intially.
ekoli: if I was in that position, posting here would be the last thing i'd do for the simple fact its publically viewable.

besides why would you want to give clues to someone you might take to court.. better the element of suprise, leave em guessing whatever its in regard to.

but its not me.. either it needs to go to court.. or just record a tune using the melody, and fund the court case using that =)

if someone thinks, i like this sound and hires people to do work instead of theft, that would be a positive side of it.

I reckon "Do It" being the single is a good thing, because it means that if this ever reaches a courtroom then A) there's an actual product with sales figures out there that can be used to estimate damages (well, kind of... nobody actually *buys* singles, but at least it stops them from saying "that track has no commercial value - it's just an album filler") - and B) it's now a lot harder for the record company to say "Gosh, an uncleared sample? That's the first we've heard of it. Thank you for bringing that to our attention, we'll sack J. Random Sound Engineer right away. There you go, we can all live happily ever after now."

And I'd love to help fan the flames again, but I think that would be of limited usefulness until we actually know what's happening on the legal front. I realise court action is slow, and I'm no legal expert, but I'm pretty sure it's not meant to go this slowly or quietly. Apparently it's now 11 months since Tempest contacted a lawyer, and all we know is that "Negotiations" are happening. Well, that could mean anything. Actual negotiations with Geffen executives? Negotiations about what colour suit his lawyer should wear when he goes out to post a letter saying 'dear mr timberland, want money plz'? Would be nice to know if the intention to release it as a single was ever mentioned in these negotiations, although maybe that's getting a bit too specific.

Dunno. I guess my impatience has just chosen this moment to boil over.

as for missy elliot. hhmm shes "ok" , but maybe not so now.. she made a whole tune out of a sample cd i have, spices of india, was a short tabla loop.. still at least in her case, it was paid for..lol
gasman: regardless of if its an album.. or single.. say it sold hhmmm 5 million albums.. u divide that by the total number of tracks .. say hmm 12-15 tracks.. singles only really exsist as i-tunes etc.. they can't drop the oh "its a filler track" .. it's a component that forms the whole thing

if i made a track , and say your record label wanted to use it for your latest compilation regardless you would have to license it off me , and depends on how your terms are.. either a)a licensing fee + a percentage of sales... .b)a BIG licensing fee + a smaller percentage..

as an artist i can demand sales figures from a label, its a legal right. so proving it was taken first, then they would have to give up the sales figures also, they can't withhold them as they can be done for purgery if they lie... my friend released a record hhm say 10 years ago now, the label boss told him he pressed 2000 copies, but in reality it was 4000 as he knew someone at the pressing plant who gave him the correct figures.

it's like my friend who does music for tv.. they try to buy usage rights off him wholesale so it becomes library music and can be used unlimited times without giving any royalties or a very small percentage..

your right though, my attitude to this whole situation is.. "you paying up" yes / no?? no.. i'd be sorting it out quickly.. summons the rip off artist in question to court. then I'd also claim for expenses.. so in reality its not costing in the end, if your principles are that strong.. the case IS very good and pretty clear cut.. even if the person in the wrong is talking a load of BS to make out like they didn't do anything wrong, bottom line is their name is on contracts, they license it for release to the label.

the amount of evidence is there, regardless of how good at misleading people a persons lawyers are, they would be have to be pretty dumb to contest it.

my attitude is call their bluff.. if they think its going to court peoples arrogance drops a lot.. its a battle of wills.

something will happen in the end of the day.. just its a case of not backing down.. f'em =)
