To do a little quoting:
Quote:
OK chaps: the first salvo against Timbaland has officially been lodged with Helsinki District Court. I'll post a news item when I have the official translation of what was lodged :)

The case against timbaland is now officially... open.

Chris

..and then this:
Quote:
{please include this warning if you copy/paste this to other forums: the below may be wrong, either in detail or in full, since I haven't seen the filing. Therefore, if anyone wants to get upset about anything... WAIT FOR THE ACTUAL FILING, and base your grievance on that! At some point I'm due to get the English translation of the filing, and then (with their permission),I'll either link to it or publish it.}

It's my understanding that the filing contests that GRG has been infringed, and that his work is sufficiently different to Tempest's as to qualify for copyright protection on its own merits. Note that I don't think this stops Tempest taking his own legal action, and it's not GRG claiming that he wrote Acidjazzed Evening: it's GRG claiming that what Timbaland stole from him was protected by copyright law by virtue of possessing creative attributes attributable to GRG himself. It's just a necessary prerequisite to establish that GRG's version was a product of skill and creativity rather than being a straight port that anyone could do, so you can then establish that it was legally possible for him to be infringed.

It's my own personal theory that Timbaland's steal had nothing to do with the original MOD, and that one of his lackeys is a SID fan, who just happened to use GRG's work. My belief is therefore that GRG's version of the track was instrumental (if you'll forgive the pun) in the composition of the piece.

Again, all disclaimers, I am not a lawyer, etc, etc, etc. Interpret with caution!

Chris

About Christ (the author of those two statements): Chris Abbott runs the publishing and record label "High Technology Publishing Ltd.", and its website C64Audio.com. He has also run events such as "Back in Time Live", an unashamedly Commodore-music based event in various glamour locations around the UK (Soho, Brighton, The City and Manchester), and written for Edge Retro Magazine and Retro Gamer.

As the current publisher for noted musicians such as Rob Hubbard, Martin Galway, Ben Daglish, David Whittaker, Richard Joseph, Tim Follin, Paul Norman, Matt Gray, Fred Gray, and the Mighty Bogg, Chris has spent a number of years policing the commercial scene to make sure that composers were given their due. A member of MCPS/PRS/PPL and STIM/NCB, he has taken successful action against numerous illegal usage of Commodore 64 music, including liaising with David Whittaker during the Zombie Nation period and initiating the licencing process.. He has been successful mostly without involving lawyers or courts. High Technology Publishing doesn't, however, currently administer GRG's or Tempest's work.

High Technology Publishing controls the rights to hundreds of original C64 tunes, both the mechanical and the phonographic rights, and is willing to licence them to record labels of all sizes for commercial use. The original composers all receive royalties on such usage.

He also wrote this brilliant analysis of the situation when it first erupted, back in January: http://www.c64audio.com/timbaland.php

gargajud: did you get my email?
Great news. Well a fat settlement would probably have been greater news for GRG and Tempest, but I personally prefer to have Timbalands ass taken to a court, where it belongs. Hopefully they will get more dough than they deserves when the verdict falls. =)

Mind you, it's also correct as Chris states on the forums of Remix64 that this is a civil court procedure; not a criminal one. As far as I know, civil lawsuits can have their verdicts overturned, so even if GRG wins the initial suit, it is no guarrantee for success (although; it sure would be sweet :)

shrimp : I'm with you on that one, why? simply because of the comments made after on a certain radio show..

such arrogance, disreguard for others work needs to be shown its simply not the way to conduct yourself. The only thing certain people understand is MONEY, so let it be that way. Since some peoples principles are very lacking.

Interesting though, he owes grg for the usage of HIS recording of the tune, but he owes tempest for the composition itself, the latter being the far bigger amount.. as he's the writer.

wonder if US courts work like the UK where you can claim damages and expenses.. now that'd be interesting.

I was wondering if he'd take me to court for the comments on youtube ;-)

would be easy money..lol

The new Timbaland?

I think the tune is from an old nes game, batman or something :) Not realy scene related, but seems that people get back to 8bit beats.

What's US producers love with 8-bit bloppy sounds nowadays? The new Britney (!) single has some blopping going on in the background throughout the whole track.

It's kind of funny. In the 1990s many MOD musicians took special care to ensure that the song sounded "professional" or even "commercial". And now what? The commercial pop has started to use lo-fi squarewaves and stuff :)
did timbaland release "Do It" as a single now? They play the track almost daily on the Swiss national radio station...

Perhaps this is what Timba-fans meant when they were calling him a "musical innovator" in all those trolling threads around the net :)
A Finnish pop magazine reviewed the "Do It" single here: http://www.stara.fi/?p=6284
Unlock: Nelly Furtado released it, but yes.

On the Britney front:
Quote:
an up-tempo dance track called 'Gimme More' produced by Timbaland protégé Nate 'Danjahandz' Hills.

So it's not quite the case that 8-bit sound is a new craze being adopted by producers across the music industry - it's still the same two guys trying to get their money's worth out of a Sidstation...

Heh, that review does look pretty excellent - I don't need to read Finnish to see that it's about as damning as it could possibly get. But all the same: translation plz kthx... :-)
