Adok: the actual problem is not about spreading stuff, it's about making money at the expense of other people's work without even asking in the first place.

The amount of money is irrelevant there (however small it is). It's a matter of principle.

without wanting to spoil the fun .. but certain people are still around here on a semi-daily basis. just a note aside. =)

and yes, to be another one on the list - asking in order to include stuff seriously wouldn't hurt. no really, it wouldn't. and asking is not a matter of money and energy either, 'cause putting that stuff together seemingly took some effort.

in my world, doing the cd and spreading it for just the cost of the cd and the shipping would be ok. gaining extra money from that, isn't.
and as keops said, it's a matter of principle. how much is actually coming out of that isn't really the interesting fact.

though .. i wonder how it went like back when imphobia dreams, the assembly compilations, and not to forget - mods anthology got on the - as it seems - scene-only market. i was never included in those things, so does anyone know if those who did above mentioned compilations actually got the permission from everyone who had his/her work on there?

Adok: thing is, that's not what this is about. What it's about is someone *selling* my track (as a part of a compilation, yes), without letting me know at all.
And as people here has written previously, I probably wouldn't mind if I were asked first. And I wouldn't have a problem with reencoding the file or giving out a .wav of the track either (to avoid the f***ing reencodes). But I never was asked, and that's what I have a problem with.
And as someone on page 1 (forgot who, sorry) so brilliantly pointed out, it's also about the control over my work. This would also to some extent apply to Willbe's demovibes project I guess, but since that only involves Willbe doing (excellent) work for free it's not really that big a deal *to me regarding my own work*.

Well, he didn't initiate that diskmag cd, he took over from some other guys who were already selling it before him. I don't know if they ever bother to asked anyone though...

Now I know why Crest doesn't have a job -- he puts all his effort into making compliation CDs rather than looking for work.
i don't care about a few measly cents, but i do care that it's _sold_ without asking. there's also one of my tunes included on this cd and i wouldn't mind if i were asked before. absolutely agree with lug00ber.

however, i do agree that crest is being stupid, he should ask at least 10 euro for these cd's (i would not do it for less for sure...) :-)

havoc: umm, no, music/demos/stuff aren't released to the public domain. The author just allows them to be copied for free, while still retaining the copyright.

Havoc: Well, none of my music was included on this particular CD. But how is one supposed to enforce their rights when the damage is already done? Wouldn't it be a lot easier if people would have the decency to ASK for permission before doing something with other people's work?

As if all those scene-cd makers in the 90s asked for permission. I think they just assumed that all this demoscene stuff is public domain anyway and in most cases it was a simple from-sceners-for-sceners thing. No big deal. I also remember the 'scene pixel graphics' cd, which was later re-labeled and sold as 'scene clip-arts' (or something) by a major software discounter. The irony is that a friggin' lot of the gfx on that disc were copyies/rips. Same problem with mod compilation cds and used samples.

And about the (old) diskmag cd. Mados put so much effort in it and the price and general interest was so low that you can't really blame him. Also, iirc the cd can/could be leeched for free.

Sceneprods may very well WORK as PD, but most of them arent'. They are released, let's say.. on the intarweb for a certain audience (basically everyone, but mostly other sceners). The actual transfer to physical media isn't controverial, but the very resale principle is.

Especially for us musicians this is bad unless we are asked first. Music is probably the most "generally accessible" scene product and can easily be sold to just about anyone. And maybe these people didn't even know it is actually for free.

I realise people make and sell such CDs for the convenience for the buyer (who doesn't have to collect it him/herself) and that there are some production costs involved. However, it is not given that the creator wanted it released this way at all. nothing of this is judicial and noone's suing anyone, but sceners should respect each other enough to at least ask for permission.
Yup, i agree. Make money this way - and it's no important it's $2 or $100 - is not fair to the author of prod. If you think it's okey- its only your opinion, somebody else may think different.
