I'm all with non-commercial sampling BUT also with crediting originals / sources. It's not like crediting sources really spoils anything from the derivative work. Moreover, I think of it as clueing in those with lesser knowledge about worthy/interesting musical stuff, be it past or present. Personally, I'll be pretty occupied checking out a bit more Socrates and Christina Courtin soonish ;)

Sadly, in this age of modern electronic music, where musicians no longer need to suffer from lack of instruments (or struggle as much with funding/building a working environment etc.), the assumption that sampling is the same as composing seems more common day by day. To make things worse, it's only the former that people seem to consider something that should be moralized on. But anyway, this topic is not the point of this discussion either, it just happened to partially tie in with my first comment ;).

And since this thread actually doesn't yet have a single image posted on it, I have the honor of posting something..:

Oh and with non-commercial sampling I meant "whatever you don't make a living out of" and "credit but don't clear". Anything else, I'd go with "clear, credit and compensate". Pretty much common sense.

I doubt random compo prizes hardly qualify as "making a living out of", at least until compo winners are able to pay their rent with fingerprint scanners and such ;)

So is Banksy trying to tell us that he's a bad artist by making it so obvious it's from someone else?

216, maybe the point was about the "kiviäkin.." ;)

Yeah, but he's talking about directing. Making movies, you know?

Get a fucking clue, dude. :)
"zplex: no, the point is, you held Jogeir up to be the guiding light of original scene-music composition. which is laughable and proves that you don't really know what you're talking about."

Ok, i am no Einstein, and i have changed my mind now, stealing and ripping is ok, it`s an honor to the original artist.

of all the stuff that I've read here I agree with what Scamp says: basically using the track without reference AND agreement from original authors was wrong, but:

1) the guys say it was a misunderstanding and they'll work towards that.

2) (and most important) they didn't gain any significant advantage from doing so in the competition.

I also believe there are some very original and some very derivative productions in the demoscene. And a whole spectrum in-between. There is no general rule that "since everything is derivative lets all do a 90% rip of music, 3d models, code, ideas etc.". Doesn't work like that. Or if it does it will eventually catch up with you one way or another.

Jim Jamusch is a director, his favorite movie is Seven Samurai. Good enough fucking clue?

xernoby: who knows, but i guess the the quote is making a general point about being creative? not just about directing films. i would guess that.

xernobyl: I feel stupid to have to say this, but where on the quote does it say anything about making films? :) way to miss the point completely..
He is quoting Godard.

I've read a book about him once... Actually it was his second most favorite black and white movie, seven samurai, being the first one Tokio Monogatari. There was also a list of his favorite color movies, which I don't recall. But I've only seen two movies he directed, so...

Talking about only original stuff... Was I the only one that got a bit shocked when saw the the istockphoto watermark on the girl on one of the steps for this graphic (4th on Freestyle Graphic compo)?

ftp://ftp.untergrund.net/breakpoint/2010/freestyle_graphics/jcs_flowergirl_final.png

I think it was also used on a Amiga demo and felt weird how everyone was clapping so mad for a purchased istockphoto with some photoshoping. I guess it's not the same as the author bought the artwork which got used on the composition, but still, was a bit shocking. I guess I've away from parties too long...

Also, it probably was discussed at that time, but I'm curious about what was the story with the Extrawelt track used on Einklang.net's theBeauty. Did pet had permission from Extrawelt?
Unfortunately I can't find the steps on the ftp.

I don't have to say anything, therefore...

extrawelt gave permission yes.

i agree with you with that 'flowergirl' pic, when you get applause for putting together a few stockphotos and knocking up a few alpha masks my 5 minutes pouet photofucks are underrated as hell :D

That pic is disappointing after seeing it in the amiga demo. It wasn't obviously using photos there, I thought it was pixeled :( Well, it's still a pretty cool pic.
